1. OBJETO Y CONTEXTO La presente cláusula regula el tratamiento y comunicación de datos personales de salud de aquellos pacientes que acceden a los servicios del Dr. Tito Rodríguez Bouza (en adelante, «el Facultativo») a través de un acuerdo de colaboración con un Centro Médico, Hospital o Policlínica externo (en adelante, «el Centro de Origen»).
2. INTEGRACIÓN EN LA HISTORIA CLÍNICA (CONTINUIDAD ASISTENCIAL) Al solicitar la consulta médica bajo esta modalidad, el paciente entiende y acepta que el Facultativo actúa como especialista externo en coordinación con el Centro de Origen. Con la aceptación de estas condiciones, el paciente AUTORIZA EXPRESAMENTE la comunicación de los siguientes datos al Centro de Origen:
- Informe clínico resultante de la consulta.
- Resultados de pruebas diagnósticas (analíticas, diagnósticos moleculares).
- Recetas y pautas de tratamiento.
Finalidad de la cesión: La finalidad única de esta comunicación es garantizar la continuidad asistencial, la seguridad del paciente y la correcta integración de la información en la Historia Clínica Única custodiada por el Centro de Origen, cumpliendo con la normativa sanitaria vigente.
3. RESPONSABILIDAD DE LOS DATOS
- El Facultativo será responsable de la custodia temporal y seguridad de los datos durante el proceso de teleconsulta y diagnóstico.
- El Centro de Origen será el responsable final del tratamiento y custodia de dicha información una vez integrada en su sistema de gestión de pacientes, aplicándose a partir de ese momento la Política de Privacidad de dicho Centro.
4. BASE LEGAL El tratamiento y cesión de estos datos se legitima en base al:
- Consentimiento expreso del interesado (Art. 6.1.a RGPD).
- Fines de medicina preventiva o laboral, evaluación de la capacidad laboral del trabajador, diagnóstico médico o prestación de asistencia sanitaria (Art. 9.2.h RGPD).
5. EJERCICIO DE DERECHOS El paciente podrá ejercer sus derechos de acceso, rectificación, supresión y oposición dirigiéndose tanto al Facultativo (contacto disponible en el Aviso Legal de esta web) como al Delegado de Protección de Datos del Centro de Origen correspondiente.
TITLE: PRIVACY ANNEX: DATA INTEGRATION WITH COLLABORATING MEDICAL CENTERS
1. PURPOSE AND CONTEXT This clause regulates the processing and communication of personal health data of patients accessing the services of Dr. Tito Rodríguez Bouza (hereinafter, «the Physician») through a collaboration agreement with an external Medical Center, Hospital, or Polyclinic (hereinafter, «the Originating Center»).
2. INTEGRATION INTO MEDICAL HISTORY (CONTINUITY OF CARE) By requesting a medical consultation under this modality, the patient understands and accepts that the Physician acts as an external specialist in coordination with the Originating Center. By accepting these conditions, the patient EXPRESSLY AUTHORIZES the communication of the following data to the Originating Center:
- Clinical report resulting from the consultation.
- Results of diagnostic tests (blood tests, molecular diagnostics).
- Prescriptions and treatment guidelines.
Purpose of the transfer: The sole purpose of this communication is to guarantee continuity of care, patient safety, and the correct integration of information into the Single Medical History guarded by the Originating Center, in compliance with current health regulations.
3. DATA RESPONSIBILITY
- The Physician shall be responsible for the temporary custody and security of the data during the teleconsultation and diagnostic process.
- The Originating Center shall be the final Data Controller responsible for the treatment and custody of said information once integrated into its patient management system, at which point the Privacy Policy of said Center shall apply.
4. LEGAL BASIS The processing and transfer of this data is legitimized based on:
- Express consent of the data subject (Art. 6.1.a GDPR).
- Purposes of preventive or occupational medicine, medical diagnosis, or provision of health care (Art. 9.2.h GDPR).
5. EXERCISE OF RIGHTS The patient may exercise their rights of access, rectification, erasure, and opposition by contacting both the Physician (contact details available in the Legal Notice of this website) and the Data Protection Officer of the corresponding Originating Center.
